Any non-plastic material should be removed from the item before adding it to the bin. Do not add liquids, semi-solids, or any non-plastic solids. Please rinse and dry any material before adding it to the bin. It is critical that no metal, silicone, rubber, wood, or paper, be added to the bins
Terms
1. The Program is only for non-contaminated, non-hazardous lab plastics.
2. Prior to mailback, Customer shall inspect the lab plastics being sent to Polycarbin via the Container to ensure
that no hazardous materials, infectants or detrimental contaminants are present, including internal surfaces and cavities of the lab
plastics. CUSTOMER IS PROHIBITED FROM SENDING HAZARDOUS OR CONTAMINATED MATERIAL OR MATERIAL WITH INFECTANTS.
3. Indemnification. To the maximum extent permitted by law, Customer shall indemnify, defend and hold harmless Polycarbin, its
officers, employees, and agents from and against all liability, loss, costs, claims, damages, expenses, judgments, and awards, whether
or not covered by insurance, arising or claimed to have arisen in whole or in part from (a) Customer’s provision of hazardous,
contaminated or infectious material through the mailback program, or (b) as a result of negligence by Customer, its
subcontractors, materialmen, or assignees and their agents or employees, that resulted in sickness, injury (including mental or
emotional) to or death of any person, including employees of Polycarbin, recyclers acting on behalf of Polycarbin and employees and
agents of those recyclers. Indemnification shall include all costs, including attorneys’ fees reasonably incurred in pursuing indemnity
claims under or enforcement of this Agreement. Polycarbin shall give Customer reasonable notice of any claim Polycarbin contends
falls within this indemnification.
